Tax Updates

Starting January 1, 2010 the IRS standard mileage rate will be 50ยข/mile.

Effective October 1, 2009, the sale of a digital good is taxable in Wisconsin (2009 Wis. Act 2).

Sales and Use Tax Audits

The Department of Revenue has been difficult to contact regarding sales tax questions. I sent the Department of Revenue a series of questions on May 5, 2009 that were specific to the film and video industry. On May 15th I was sent an email telling me I would have answers in 30 days. I received the answers on July 19th.

The questions were in depth and certainly did not have a simple answer, but I was hoping they could answer my questions a bit more quickly considering they have been auditing companies for years based on these issues.

The answers so far have not simplified the issue and follow up questions produced what would appear to be contradictions. Consider these two answers regarding VTR:

July 19 - The conversion of data from a tape to a computer hard drive alone is not a service that is subject to Wisconsin sales or use tax.

November 6 - The duplication service is a taxable photographic service.

The questions were regarding VTR, not duplication. Does the Department of Revenue see them as the same thing? It's hard to tell. The law can be difficult to understand, but if the agency that enforces the law can't understand it, or can't explain it, how can they expect anyone else to?
